Prosecutor’s Office: Sexual Assault Allegations by Convict Giorgi Davitadze Not Substantiated

The Prosecutor’s Office of Georgia has concluded its investigation into the alleged sexual assault of convict Giorgi Davitadze, who is serving his sentence in Penitentiary Facility No. 6 in the city of Rustavi.

According to the agency, the evidence gathered confirms that no violent or criminal acts were committed against Davitadze during his inspection in the de-escalation room. Consequently, a decision was made to terminate the criminal proceedings.

“For the purpose of informing the public, we clarify that on December 29, 2025, the investigative division of the Kvemo Kartli District Prosecutor’s Office opened a criminal investigation into the alleged abuse of official authority involving violence against Giorgi Davitadze, under subparagraph ‘b’, Part 3 of Article 333 of the Criminal Code of Georgia.

During the investigation, dozens of witnesses were questioned, including fellow inmates held in the same facility; forensic examinations were performed; dozens of hours of video footage were analyzed; and a comprehensive range of investigative and procedural actions was carried out.

The investigation established that by a verdict of the Tbilisi City Court on October 6, 2025, Giorgi Davitadze was found guilty of crimes under Article 19-109 (subparagraph ‘b’) and Parts 3 and 4 of Article 236 of the Criminal Code of Georgia (attempted murder under aggravating circumstances, and the illegal acquisition, possession, and carrying of firearms). He was sentenced to 17 years and 6 months of imprisonment.

Following his conviction, on October 10, 2025, he was transferred from Facility No. 8 of the Special Penitentiary Service to High-Risk Penitentiary and Detention Facility No. 6. On December 21, 2025, at around 10:30 a.m., during a routine cell inspection, Giorgi Davitadze verbally abused facility staff, threatening the duty shift with self-harm and physical violence. In this regard, he was transferred to de-escalation room No. 6, where he continued to show aggression and insult penitentiary staff.

Following his transfer to the de-escalation room, a proportionate coercive measure was applied to conduct a personal search of Davitadze in accordance with legal requirements. Specifically, three facility officers restrained the convict, while one of them, G. V., conducted a pat-down search. A metal detector was also utilized during the inspection. No violent or criminal acts were committed against Giorgi Davitadze during the search,” the statement reads.

The Prosecutor’s Office also stated that five days after the incident, during a conversation with a visiting representative from the Office of the Public Defender of Georgia, Davitadze made no allegation of rape. He stated that a facility officer, identified only as ‘Kvara’, had threatened him with rape and put a gloved hand into his trousers. He also alleged that prison staff systematically subjected him to verbal abuse.

“Giorgi Davitadze was questioned on January 12, 2026, in the presence of his attorney. It was only at this stage of the investigation that he claimed acts of sexual violence had allegedly been committed against him. However, in the presence of his attorney, Davitadze refused to undergo a forensic medical examination, stating that he had sustained no bodily injuries during the incident. It is also noteworthy that the alleged perpetrator named by Davitadze—a certain ‘Kvara’, later identified as Giorgi Kvaratskhelia—does not work at this penitentiary facility at all.”

On July 3, the defense attorney filed a motion with the prosecutor’s office requesting that his client be recognized as a victim; the request was denied on the same day and was not appealed. The statement noted that audio-video and habitoscopic (forensic facial identification) examinations were also performed as part of the case: a forensic expert decoded the CCTV footage from de-escalation room No. 6 second-by-second, fully reconstructing the sequence of events during Davitadze’s personal search.

“According to the findings of the forensic examination, the video recordings provided contain no evidence of violent actions against Giorgi Davitadze. Furthermore, no signs of tampering or editing were found in the recordings. The examination thus definitively ruled out the commission of criminal acts against the inmate.

The investigation and the totality of examined evidence have reliably established that the information provided by Giorgi Davitadze is factually inaccurate and directly contradicts the evidence collected in the case. Accordingly, on October 9, 2026, the criminal proceedings were closed due to the absence of the elements of a crime,” the Prosecutor’s Office statement concluded.
